General terms and conditions


Entering into contract


Thomaskirche Bach 2000 Marketing GmbH, Thomaskirchhof 18, 04109 Leipzig, (Tel. 0341 / 22 224-200, Fax 0341/22 224-205, E-Mail, HBR 14375, District Court Leipzig) and the purchaser agree that the following General terms and conditions will apply. Our offers are always without engagement regarding type, quantity, price, delivery time and availability, unless otherwise agreed in writing. Supply contracts shall result either from our written acknowledgement of order (via e-mail) after the purchaser's order, from our delivery or upon payment of the goods on site. All oral agreements, especially any kind of supplementary agreement, including such regarding the fulfilment of the order, shall need our separate written confirmation to become valid.


Delivery information and costs


Delivery costs depend on the delivery scope and the destination of delivery. The exact amount of delivery costs is given in the shopping basket. For national orders of ¤ 100.00 and above, delivery is free of charge. This does not apply to concert tickets delivered by Thomaskirche Bach 2000 Marketing GmbH. The shipping and service charge for concert tickets is usually ¤ 4,90.

The general delivery time for an order from inside Germany is about 7 working days from receipt of order. General delivery time for international deliveries may range from 5 to 25 working days depending on the region. Delivery costs for international orders will be calculated on an individual basis depending on weight and destination of the delivery.

We will check your purchase order regarding availability and contact you via E-Mail or phone if product(s) of your purchase order cannot be delivered in short-term.

Thomaskirche Bach 2000 Marketing GmbH shall be entitled to part deliveries as far as it is reasonable to the purchaser. This shall not incur any extra delivery cost for the customer.

If a shipment cannot be delivered due to wrong or incomplete information by the buyer, the buyer will be charged with the additional costs.


Prices and terms of payment


The given prices do not include delivery costs, but include the VAT currently valid in Germany.

The ordered products / tickets can be paid by credit card, invoice or direct debit. If you order for the first time or the value of your orderexceeds ¤ 100.00 , we will reserve the right to accept payments only as advance payment (credit card or payment transfer). International purchase orders can be paid only by credit card.

If you pay on account, it will be enclosed to the delivery. The invoice is to be paid within 14 days after receipt of the delivery. Purchases made on site at our shop can be paid by credit Card or cash.


Conditional sale


All goods shall remain the property of the Thomaskirche-Bach 2000 Marketing GmbH until full payment of the agreed purchase price has been received.


Right of Withdrawal


As far as Thomaskirche Bach 2000 Marketing GmbH offers services in the name of event organisers in the area of leisure activities, especially tickets to events, this shall not be considered a distance contract under Section 312 b BGB (German Civil Code). This means that the two-week right of return will not apply in this case. Thus each ordering of tickets shall become binding directly after confirmation by Thomaskirche Bach 2000 Marketing GmbH in the name of the organiser, and will oblige the customer to accept and pay the ordered tickets.


Right of Withdrawal for Consumers


Consumers have a right of withdrawal according to the following provisions. A consumer, within the meaning of Section 13 BGB (German Civil Code), shall be every natural person who enters into a legal transaction for a purpose that is predominantly outside his trade, business or profession.


Withdrawal Policy


You have the right to cancel this contract within 14 days without giving reasons. The cancellation period is fourteen days from the date on which you or a third party appointed by you, who is not the forwarder, took possession of the goods. To exercise your right of withdrawal, you must inform us

of your decision to cancel this contract by means of a clear statement to this effect (e.g. a letter sent by post, fax or e-mail). You can download and submit the specimen withdrawal form on our website or use any other explicit form of communication. The withdrawal period has been observed as long as you dispatch the notification that you are exercising your right of withdrawal before the end of the withdrawal period.


Consequences of Withdrawal


If you cancel this contract, we shall refund to you all payments which we have received from you, including delivery charges (except for additional costs incurred as a result of the fact that you requested a type of delivery other than the cheapest standard delivery offered by us) without delay and at the latest within fourteen days from the date on which we receive the notification of your cancellation of this contract. For this refund we shall use the same means of payment that you used in the original transaction, unless expressly otherwise agreed with you; under no circumstances shall any charges be debited to you for this refund.
We reserve the right to refuse a refund until we have received the goods or until you have provided proof that you have returned the goods, whichever of these occurs first.
You shall send back or hand over the goods to us without delay, at the latest within fourteen days of the date on which you notify us about the cancellation of this contract. The dispatch of the goods before the expiry of the 14-day period is sufficient to observe the period. You shall be responsible for the direct costs of returning the goods. You are only responsible for any loss of value of the goods if such loss of value is the result of handling not required to determine the suitability, characteristics and function of the goods.


Exceptions from the Right of Withdrawal


The right of withdrawal does not apply for contracts regarding
  • the supply of goods which are not pre-manufactured and which were made to the customer’s specifications, based on an individual choice by the customer or clearly personalized;
  • the supply of goods which are liable to deteriorate or expire rapidly;
  • the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, the delivery of which can only take place after 30 days and the actual value of which is dependent on fluctuations in the market which cannot be controlled by the trader;
  • the supply of newspapers, periodicals or magazines with the exception of subscription contracts.



    The warranty complies with the legal rules of the BGB section 434 et seq. This warranty is limited to delivered product(s) and does not apply to consequential damage as well as damages or malfunctions attributed to improper handling or normal wear and tear.


    Data protection


    Thomaskirche Bach 2000 Marketing GmbH keeps customer data strictly confidential. We save data necessary to process your purchase order(s). These are at first your address data and your payment details. Furthermore the corresponding order data (order date, order number, mode of shipment, item(s), quantity, unit and total price) are assigned to your address data within the scope of your purchase order. Thomaskirche Bach 2000 Marketing GmbH does not make customer data available to third parties.


    Place of jurisdiction


    Place of jurisdiction is Leipzig. Regarding all legal relations between us and the customer, the law of the Federal Republic of Germany shall apply with the exception of the "Vienna Sales Convention" 1980 (CISG) even if the customer has his domicile or headquarter abroad.


    Severability clause


    If any of these regulations is not valid, then the validity of the remaining regulations shall not be affected. The invalid clause shall be replaced by a regulation which is economically closest to it.
